Terms & Conditions

The terms for using Valliant internet and phone service, plus our Acceptable Use Policy. Written in plain language so you know what to expect.

Draft for review. This page is a working draft prepared for Valliant Telephone Company, Inc. and its attorney to review and approve. It's not yet a final, binding agreement. Please don't treat it as legal advice or as the official terms of service until it has been reviewed, finalized, and dated.

Effective date: [to be set]

Welcome, and thank you for choosing Valliant. These Terms and Conditions ("Terms") explain the agreement between you ("you," "customer," or "subscriber") and Valliant Telephone Company, Inc. ("Valliant," "we," "us," or "our") when you order or use our internet, home phone, or related services. We've tried to keep this clear and fair. If anything is confusing, call us and we'll be glad to walk you through it.

1. Acceptance of these Terms

By ordering, installing, or using any Valliant service, you agree to these Terms. If you don't agree, please don't use the service. If you're accepting these Terms on behalf of a household, business, or other organization, you confirm that you're authorized to do so. These Terms apply along with any plan details, order forms, or pricing we provide to you.

2. Service availability and best-effort speeds

We provide service in parts of McCurtain, Choctaw, and Pushmataha counties in Oklahoma, including towns such as Valliant, Millerton, Rufe, Sawyer, Garvin, Swink, Fort Towson, Hugo, Grant, Rattan, Spencerville, and Antlers. Not every service or speed is available at every address. We'll check what's available at your location before we set up service.

Internet speeds are described as "up to" a stated maximum. On our fiber network we work hard to deliver the speed of your plan, but actual speeds can vary based on your equipment, your in-home wiring and Wi-Fi, the websites and services you use, and overall network conditions. Our fixed wireless service is provided on a best-effort basis: the speed you receive depends on your location, your distance from our equipment, and a clear line of sight, and it can change over time. We don't guarantee a specific speed at all times.

3. Plans, pricing, and taxes

Our current residential offerings include:

Prices listed are the base monthly charges for the service and don't include applicable federal, state, and local taxes, fees, and surcharges, which will be added to your bill. We may update plans and pricing from time to time. If we change the price of your current service, we'll let you know in advance, and the change will apply to future billing periods.

4. Installation fee and equipment

A one-time installation fee of $200 applies to new fiber and DSL service. This covers the work to bring service to your home and get you connected. For some services, you'll need to provide or lease an appropriate modem or other equipment. If we tell you that specific equipment is required, you're responsible for having compatible equipment in place. Any equipment we own and lease to you remains our property, should be kept in good condition, and must be returned to us if your service ends.

5. Billing, due dates, late payment, and reconnection

We bill on a regular monthly cycle. Your bill shows the amount due and the due date. Payments are due by the date shown. You can pay online, set up automatic payments by ACH, or pay in person at our office at 100 Wilson St in Valliant.

If a payment is late, a late charge may apply. If your account stays past due, we may suspend or disconnect your service after providing notice as required. To restore service after a disconnection for non-payment, you'll need to pay your outstanding balance, and a reconnection charge may apply. If you believe there's an error on your bill, please contact us promptly so we can look into it.

6. Term and cancellation

Our residential fiber and DSL services don't require a long-term contract. You may cancel these services at any time. You remain responsible for any charges incurred up to the date service ends, and for returning any leased equipment.

Fixed wireless service is provided under a two-year term. If you cancel fixed wireless before the end of that term, an early termination charge may apply as described in your service order. To cancel any service, contact our office by phone, text, email, or in person.

7. Acceptable Use Policy

We want everyone in our service area to have a fast, reliable connection. To keep the network healthy and fair for all customers, you agree to use our services responsibly. You agree that you'll not:

Our residential internet plans have no data caps, and we don't charge overage fees for normal use. "No data caps" isn't a license for abuse, however. We use reasonable network management practices to keep the network running well for everyone, which can include addressing activity that harms the network or other users. If we believe your use violates this policy, we may contact you, and where necessary we may limit, suspend, or end service after notice as appropriate.

8. Home phone and emergency calling

Our home phone service includes features such as caller ID and voicemail. Please be aware that phone service depends on power and a working connection, and service can be affected during outages. Make sure we've your correct service address on file so that emergency calls are handled properly.

9. Lifeline program

Lifeline is a federal program that helps make phone and internet service more affordable for customers who qualify. If you're eligible, a Lifeline discount can reduce your installation fee and your monthly charges. Lifeline is limited to one benefit per household, and eligibility rules are set by the program. Call us and we'll help you check whether you qualify and how to apply.

10. Privacy and customer information

We collect the information we need to provide and bill for your service, such as your name, service address, contact details, payment information, and basic account and usage records. We use this information to set up and support your service, send you bills and notices, and operate our network.

We don't sell your personal information. We handle Customer Proprietary Network Information (CPNI), which includes details about the services you buy and how you use them, in accordance with Federal Communications Commission (FCC) rules. We share information with others only as needed to provide service, to process payments, or as required or permitted by law.

11. Service interruptions and maintenance

From time to time we need to perform maintenance, upgrades, or repairs, and weather, equipment issues, or events outside our control can cause outages. We'll work to keep interruptions short and to restore service as quickly as we can. When we plan maintenance that may affect you, we'll try to give advance notice where practical.

12. Limitation of liability and no warranty of uninterrupted service

We provide our services on an "as is" and "as available" basis. While we work hard to deliver dependable service, we don't warrant that the service will be uninterrupted, error free, or free from delays, outages, or other issues. To the fullest extent allowed by law, Valliant isn't liable for indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the service, including lost profits or lost data. Nothing in these Terms limits any rights you've that can't be limited under applicable law.

13. Changes to these Terms

We may update these Terms from time to time. When we make a material change, we'll post the updated Terms and update the effective date, and we'll provide notice as appropriate. If you continue to use the service after a change takes effect, that means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of laws rules. Any dispute relating to these Terms or to your service will be handled in accordance with applicable Oklahoma and federal law.
